Court Orders Investigation
After recording the plaintiff’s statement and acknowledging the seriousness of the matter, the court instructed the Police Bureau of Investigation (PBI) to submit a detailed report on the allegations against the accused.
Claims in the Complaint
According to the case statement, freedom of practicing religion is a fundamental right under Article 41 of the Constitution of Bangladesh. It mentions that marriage is an important Islamic practice, and as stated in the Qur’an (Surah An-Nisa, verse 3), a Muslim man is permitted to marry up to four wives.
The complaint also highlights that under the Muslim Personal Law (Shariat) Application Act, 1937, Islamic Shariah is applicable in matters like marriage, maintenance, and divorce when both parties are Muslim.
The plaintiff argues that while a person may choose not to practice religion, no one has the right to insult a religion or hurt religious beliefs.
