Government Employees May Face Forced Retirement for Protests

The government has issued a new law that allows dismissal or forced retirement of government employees if they join protests or obstruct others from doing their duties.

New Ordinance Published

On Wednesday night (24 July), the Ministry of Law, Justice, and Parliamentary Affairs published the ‘Government Job (Second Amendment) Ordinance 2025’ in the official gazette. The ordinance was signed by Dr. Hafiz Ahmed Chowdhury, Secretary of the Ministry.

Disobedience Now Considered Misconduct

According to the amendment, disobeying a lawful order from the government will now be considered “misconduct that creates disruption in government service.”

“সরকারের বৈধ আদেশ অমান্য করাকে সরকারি কর্মে বিঘ্ন সৃষ্টিকারী অসদাচরণ হিসেবে উল্লেখ করা হয়েছে।”
(“Disobeying lawful government orders is defined as misconduct that disrupts government service.”)

What Is Considered Misconduct?

Section 37 of the updated ordinance outlines several actions that will now be treated as misconduct:

  • Disobeying lawful instructions from higher authorities

  • Refusing to follow government orders or circulars without legal reason

  • Obstructing implementation of government decisions

  • Encouraging others to break these rules

  • Being absent from work with others or blocking fellow employees from doing their job (unless on official leave)

“সরকারি কর্মচারীরা অন্যদের কাজে বাধা দিলে সেটি অসদাচরণ হিসেবে গণ্য হবে।”
(“If government employees prevent others from working, it will be treated as misconduct.”)

Punishments for Misconduct

If an employee is found guilty of such acts, they may face:

  • Demotion to a lower position or salary grade

  • Forced retirement

  • Termination from job

New Rules for Investigation

The amendment also introduces a new rule for investigations. Instead of a single investigator, a three-member committee must be formed. One member of this committee must be a woman. Employees will also be given a chance to defend themselves during the process.

No More Appeals to the President

Unlike the previous ordinance, this amended version does not allow appeals against the President’s decision.

“রাষ্ট্রপতির আদেশের বিরুদ্ধে আপিল করার সুযোগ আর থাকছে না।”
(“There will no longer be an option to appeal the President’s decision.”)
